The owners can try to do whatever they want. My point is why would I agree to any of that if I'm SP? If the company is in as dire straits as it seems, I just say, "ok, sue me."

I'm not trying to say that SP has to agree if it has no desire to do so.

I'm thinking about 2 differents kind of customers:

1) The ones with an amp that all upgrades/repairs have been paid for. For them the outcome is more problematic. SP has the amp and the money is probably gone already. And you're right the "sue me" response is available to SP.

2) But for the ones who haven't paid the remaining balance for the same services I cant imagine SP isn't interested to access this new source of cash. Can the customers nail SP to the ground and impose their solution? The answer is clearly no. But the SP thirst for new $ could probably be use the way I was referring.

When you guys who deal with Mikhail (Icarium, blubliss, etc.) are talking to him over the phone, are you showing him that you're angry and very tired of all this mess? If it was me, I'd have trouble controlling my language and not shouting at him after all these lies. It's easier to tell BS in email than in real life, I'd be curious to hear how he defends himself in a live conversation.

When I was waiting for something to be delivered I was very forceful with him on the phone. I also made ultimatums via email about making the situation public, which I did. I harangued him daily until he delivered my amps. It was an exhausting, and extremely frustrating process.

Whenever I speak with him now I almost always bring up the problems that others' are complaining about. He is the excuse meister, whether it be snow, too much work, or whatever. I asked if he was financially in trouble just the other day, mentioning the fact that he had put the Audio Note 5 up for sale at Agon, and all he said was "I'm fine". Considering all the untruths that come out of his mouth I put no credence in this declaration of financial solvency.

I'm pretty forceful myself, but I'm not a hardcore dick about it. When I express my frustration I can get quite loud as I am venting... but I mean at some point I realized that no matter what he says or I get him to say it's meaningless. His word is meaningless. Him saying it'll ship is meaningless. Everything is meaningless. I can use logic. I can use emotion. I can use whatever but whatever he says in response is meaningless.

Unfortunately for those people, I think Mikhail does do a fair bit of business outside HF. There are at least a couple more stories that I have heard but are not posted, but they seem to be coming out slowly but surely.

I have heard that before, but I never really understood how that could be possible? :confused:

You wouldn't believe the complaints i heard from different meets from people who don't wanna go public...

not sure why they don't go out and talk, maybe they feel duped or stupid or maybe they want to resell the amp to someone who don't know any better...

call me Captain Oblivious but SP owners are fucked, it maybe time to get out and sell while you can recoup something cause the more the comes out to the public, the resale price of your amps go down.

As I wrote, the customers under the profile 1 (the ones that are waiting for their already upgraded/repaired amp in exchange for $) there's hope for mediation.

But now for the customers under the profile 2 (the ones with no upgraded/repaired done yet to their amp + no obligation to send $ to SP since they are simply waiting for the amp to come back) they should consider this:

They must create a time limit with documentation (ex. one month). This document has to express the owner intention to abort any project (repair or upgrade) and tell in clear terms that the amp must be return to the owner at the end of the time limit.

When this time delay will come to an end they could have a starting block to explore the criminal law scenario. With a group of individuals in the same situation chances are that the local police could start an investigation.

Does such a document need to be notarized or anything? If you want to PM me details of such a document I am down. Though supposedly mine has already had work done to it... in fact its been packed and in boxes since last Saturday! Somehow shipping it is neigh impossible though.

He didnt even bother to give me an excuse for Thursday and why it didn't go out. I guess when he runs out of excuses he just stops communicating. Joyous. I wonder if this is some sort of revenge for what I've posted regarding my situation and his business on here and head-fi. Shrug.

Well, I guess I spoke too soon on the R10s. I just got a package today. He didn't even tell me he had sent them. Now I have to see if they still function.

The pads look a lot worse than when I sent them and there is a large gap between ones of the earcups and the frame that was not that bad before.

I wonder if Alex would even work on them for me. Can you guys think of anyone else? I don't want to send them to Mikhail who actually has the most experience with the R10s. I need to recable them as well, but this is a pair where it is too delicate to take the drivers out so it has been recabled outside the drivers.

I'm not a USA resident but USPS has certainly a service with a signed confirmation of your letter delivery. Dont forget, if you fall into the client profile who is still keeping some $ before SP send you the items scenario, they'll probably ignore your letter since they have probably under Colorado law the right to keep the repaired/upgraded items until they receive all the money.

If you aren't under any obligation to send more money, and they still keep your items, you have a green light. Good luck.

Yeah I second Alex. Besides the well documented Jena Labs incident I know he has resurrected another pair of R10s that from what I recall had damaged drivers from being knocked over onto the ground or dropped or something. Yeah sorry for the lack of specifics its been awhile since I heard the story. Either way I think he is your best bet.
