The Senate will not confirm while he's President. He'll have an interim Justice ready to appoint when the Senate is out of session. The GOP will figure out a way to always be in session. Who breaks ties in the SCOTUS? I guess the lower court ruling that was appealed to the SCOTUS would still stand... never was too excited about my con law classes.
